Terms of Service
Marketplace terms
These terms govern access to and use of the ShinHQ medical-tourism marketplace by patients, clinics, agencies, and their authorized representatives.
Effective and last updated: August 12, 2026
Agreement & marketplace role
1. Agreement and operator
By accessing or using ShinHQ, you agree to these Terms and our Privacy Policy. ShinHQ operates from Seoul #106-208, B1F, 10 Gangnam-daero 51-gil, Seocho-gu, Seoul 06627, Republic of Korea. If you use ShinHQ for an organization, you confirm that you may bind it to these Terms.
2. The marketplace
ShinHQ provides technology and coordination services that help patients and agencies discover and communicate with independent clinics, and help clinics manage international enquiries and bookings. Features may include listings, availability, messaging, translation, document exchange, booking, payment coordination, dashboards, and APIs where made available.
3. ShinHQ is not a medical provider
ShinHQ does not practice medicine, diagnose conditions, prescribe treatment, or guarantee clinical outcomes. Clinics and their licensed professionals are independently responsible for consultations, suitability decisions, informed consent, treatment, pricing, and medical records. Marketplace content is general information, not medical advice. Seek qualified medical or emergency assistance when appropriate.
Participation & bookings
4. Eligibility and accounts
- Provide accurate, current information and keep credentials secure.
- Use the service only if legally capable of entering the relevant agreement, or through an authorized representative.
- You are responsible for activity under your account and must promptly report unauthorized access.
- We may request identity, authority, professional-license, clinic, or business verification.
5. Responsibilities by participant
- Patients and representatives must provide accurate information, disclose relevant health information to the treating clinic, review clinic instructions, and obtain required travel documents.
- Clinics must maintain licenses and insurance required by law, provide accurate listings and availability, protect patient information, obtain informed consent, and deliver care under applicable professional standards.
- Agencies must have authority to act for each patient, obtain required consents, represent services accurately, and comply with consumer, advertising, referral, and privacy laws.
6. Bookings and communications
A request is not confirmed until the applicable confirmation is issued. Availability, treatment suitability, and final scope may change after clinical review. Users authorize ShinHQ to route relevant information and communications among the patient, authorized representative, clinic, and agency to coordinate the requested service. Translations and coordination support may contain errors and do not replace direct confirmation with the clinic.
Commercial terms & acceptable use
7. Prices, payments, commissions, and taxes
Displayed estimates may change after consultation. The price, deposit, payment schedule, currency, agency commission, refund terms, and taxes shown or agreed for a specific transaction control that transaction. Payment services may be provided by third parties. Each participant is responsible for its own taxes and bank or currency-conversion charges.
8. Cancellations, refunds, and no-shows
The cancellation, rescheduling, refund, deposit, and no-show rules disclosed for a booking apply. Clinic decisions required for patient safety may affect a booking. Travel and accommodation costs are not refundable by ShinHQ unless expressly stated in the applicable booking terms.
9. Travel and treatment risks
Users are responsible for passports, visas, insurance, travel arrangements, and compliance with entry and health requirements. Medical procedures and travel involve risks. ShinHQ does not guarantee results, recovery times, eligibility, travel authorization, or uninterrupted availability of any clinic or professional.
10. Acceptable use
- Do not submit unlawful, false, misleading, infringing, harmful, or unauthorized content.
- Do not scrape, reverse engineer, disrupt, bypass access controls or rate limits, introduce malicious code, or misuse personal or medical information.
- Do not use the service for unlicensed medical activity, improper referrals, deceptive advertising, harassment, discrimination, or fraud.
Content, availability & enforcement
11. Content, privacy, and intellectual property
You retain ownership of content you submit and grant ShinHQ the limited rights needed to operate, secure, and improve the service. You confirm that you have the necessary rights and consents. ShinHQ and its licensors retain all rights in the marketplace, software, design, trademarks, and documentation. Personal information is handled under our Privacy Policy.
12. Third-party services and availability
Clinics, agencies, payment providers, travel providers, and linked services are independent third parties. Their terms may also apply. We may change, suspend, or discontinue features and do not promise uninterrupted or error-free availability.
13. Suspension and termination
We may restrict or end access for breach, non-payment, suspected fraud, safety or security risk, legal requirements, or harm to users or the marketplace. Provisions that by nature should continue—including payment, ownership, disclaimers, liability, and dispute provisions—survive termination.
Liability, disputes & changes
14. Disclaimers and liability
To the extent permitted by law, the service is provided “as is” and “as available.” ShinHQ disclaims implied warranties and is not responsible for independent clinical decisions, treatment outcomes, travel disruption, third-party conduct, or indirect or consequential loss. Nothing in these Terms excludes liability that cannot legally be excluded.
15. Indemnity
To the extent permitted by law, organizational users agree to defend and indemnify ShinHQ against third-party claims arising from their content, services, legal violations, professional conduct, or breach of these Terms.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules. Courts with jurisdiction over ShinHQ’s registered office will have exclusive jurisdiction, except where mandatory consumer law provides otherwise.
17. Changes and contact
We may update these Terms and will post the revised version with its effective date. Continued use after the effective date constitutes acceptance where permitted by law. Questions can be sent to legal@shinhq.com.
